Heard learned Counsel for the applicant - wife. The respondent - husband though served with notice but remained absent.

The applicant - wife is seeking transfer of Regular Civil Suit No.313 of 2022 pending in the Court of Civil Judge Junior Division, Shrirampur, Dist. Ahmednagar filed by respondent - husband for restitution of conjugal rights to the Court of Civil Judge Junior Division, Jamkhed, Dist. Ahmednagar.

According to the applicant - wife, she is not having Pooja K.

985-MCA-121-2023 independent source of income and she is maintaining three years old daughter without any financial support from the respondent - husband. There is no oppose to the application. As such, considering the convenience of applicant - wife, following order is passed :

ORDER

(i) The application is hereby allowed.

(ii) Regular Civil Suit No. 313 of 2022 pending in the Court of Civil Judge Junior Division, Shrirampur, Dist. Ahmednagar is transferred to the Court of Civil Judge Junior Division, Jamkhed, Dist.

Ahmednagar for disposal according to law.

(iii) The respondent is directed to appear before the Court of Civil Judge Junior Division, Jamkhed, Dist. Ahmednagar, on or before 15th July, 2023.
