This is a matter of abdication by the concerned Executive Magistrate in implementing the order passed by the District Magistrate under section 14 of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (Act). 2.

The District Magistrate had passed the order on 11-10-2021 and the respondent - Executive Magistrate / Tahsildar has been sitting over it. We direct the District Magistrate to enquire into it and if necessary, propose a disciplinary action against erring officials. 3.

The learned AGP, on written instructions from the Executive Magistrate concerned, informs that now a notice has been issued pursuant to the order passed under section 14 of the Act on

2 CP / 416 / 2024 04-05-2024 and in the wake of ongoing elections, actual implementation would be done by 7 June 2024.

We accept this statement as an undertaking to the Court and dispose of the contempt proceeding.
