The Petitioners are aggrieved that the approval to their transfer as assistant teachers from the unaided establishment to the aided establishment, is pending with Respondent No.3. The employer is a minority institution.

The learned A.G.P. representing the State and Zilla Parishad submits that the proposals can be decided within a time frame.

In view of the above, this petition is disposed off. The pending proposals dated 01.12.2022 and 01.01.2023, shall be decided by Respondent No.3 on it's own merits, within 60 days from today.

Needless to state, since the circular dated 1st December, 2022, staying the operation of Rule 41A of the Maharashtra Private Schools (Conditions of Service) Rules, 1971, has been stayed by this Court, the pending proposal would be considered by the Education Officer in the light of Rule 41A.
