Learned counsel for the petitioners submits that in view of the judgment of the Hon'ble Supreme Court in the case of Gurudassing Nawoosing Panjwani Vs.State of Maharashtra and others reported in 2015(6)Mh.L.J.915, against the impugned order, an alternate remedy of revision/appeal is maintainable before the state government. 2.

In view of the same, he seeks leave to withdraw the present writ petition and apply to the revisional authority to challenge the impugned order. He also submits that time taken in prosecuting the matter, should be excluded in computing the period of limitation in filling of revision petition.

Leave granted. This petition is permitted to be withdrawn with

In the event, the revision petition is filed within four(04) weeks, time taken in prosecuting the present matter should be excluded in computing the period of limitation in filing revision before the revisional authority.

Interim order is in operation from 20.12.2017 and the same will continue to operate for further period of four (04) weeks from today.

The Writ Petition is dismissed as withdrawn with liberty as prayed.
