1) Heard. It is not in dispute that the appeal filed by the State has been dismissed by this Court. It is further not in dispute that the State has deposited the amount of compensation in this Court, as was directed. It is further not in dispute that some part of the said amount, which was not permitted to be withdrawn, was invested in FDR in State Bank of Hyderabad, High court Branch.
2) As has been brought to the notice of
this court by learned counsel appearing for the appellant as well as Respondent No.3, the amount of interest accrued on the FDR has not been remitted in favour of the original claimants. 3) In view of the fact that the appeal has been dismissed, the original claimants are entitled to receive the amount of interest also. Hence, the following order, -
ORDER
i) The amount of interest, and if some more interest is accrued along with that interest amount, on compensation deposited in FA No. 1023/2004 in State Bank of Hyderabad, High Court branch, Aurangabad, shall be remitted in favour of the applicant and Respondent No.3 in equal proportion separately in their respective names by following due procedure;
ii) The Civil Application stands disposed of.
