Learned counsel for the applicant would submit that the application for anticipatory bail was heard by the learned Sessions Court and the case was reserved for orders. In the meantime, the charge sheet was filed which was not brought to the notice of the Sessions Court. Hence without referring to the fact of filing the charge sheet, the bail application has been decided. Learned counsel for the applicant would submit that a liberty may be granted to file a fresh anticipatory bail application before the Sessions Court as he would have an opportunity to point out the material against the applicant.

Hence, liberty is granted to the applicant to file fresh anticipatory bail application before the concerned Sessions Court.
