IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 14 WRIT PETITION NO.5615 OF 1999 WITH CIVIL APPLICATION NO. 1438 OF 2002 IN WP/5615/1999 DNYANESHWAR SAHAKARI S.M.P.SANSTHA LTD AND ORS.

VERSUS

STATE OF MAHARASHTRA AND ORS.

...

AGP for Respondent Nos. 1 to 4 : Shri N. T. Bhagat ...

CORAM : RAVINDRA V. GHUGE, J.

DATED : 06th JULY, 2019.

...

PER COURT :

1.

The learned AGP submits that a cooperative election issue was involved in this Writ Petition No. 5615/1999. The Assistant Registrar Cooperative Society had remanded the proceedings by the impugned order. This Court has specifically refused interim relief to the petitioner on 09/12/1999. Even if it is presumed that elections are held once in five years, four elections must have occurred since the pendency of this petition. He, therefore, submits that the petition is rendered infructuous.

2.

I find from the impugned order that the same has

14-wp-5615-99.odt resulted in setting aside the order of the Divisional Joint Registrar Cooperative Society dated 27/07/1999 and the Assistant Registrar Cooperative Society, Bombay has remitted the proceedings.

3.

As such, this petition being rendered infructuous, stands disposed off. Rule is discharged.

4.

The pending Civil Application, does not survive and stands disposed off.
