Usha Manohar Sontakke v. The State Of Maharashtra And Others
1 WP 3795/13
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 921 WRIT PETITION NO. 3795 OF 2013 USHA MANOHAR SONTAKKE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Advocate for Petitioner : Mr. Dighe Pravin S. AGP for Respondents/State : Mr. R.V. Dasalkar Advocate for Respondent No.4 : Mr. S.S. Deshmukh ...
CORAM : T.V. NALAWADE AND SUNIL K. KOTWAL, JJ.
DATE : 21st MARCH, 2018 PER COURT :
This petition is filed for issuance of directions to the respondents to take appropriate steps. It appears that some card holders who are attached to shop No.28 had made complaints to the District Supply Office to make inquiry or to see that their cards are transferred to the other shop like shop No.31. It is the grievance of the petitioner,
2 WP 3795/13 who is shown as member of the family of one card from amongst 38 cards. It appears that order of the authority is not complied with and even at present, 38 cards are attached to shop No.28. The submissions made and the record show that subsequently, most of the complaints, the 38 card holders retracted their previous complaint by saying that they have not signed on the complaint and they are willing to collect the ration from shop No.28. The petitioner is still saying that she is not satisfied with the service of shop No.28 and she wants to get her card attached to shop No.31.
2.
The submissions made show that the petitioner was aged about 28 years on the date of filing of petition. There is possibility of her marriage. Similarly, there is possibility that the Card was issued in the name of her father and she is only member of that family, and in that case, the father/main person, in whose name Card is issued, needs to apply before the authority to transfer his Card from shop No.28 to shop No.38. If such an
3 WP 3795/13 application is made by the father, then the concerned authority needs to consider that request and take steps to see that the said Card is attached to other shop.
3.
With above observations, Writ Petition stands disposed of.
