1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 0425/2024, registered with Pundliknagar Police Station, Aurangabad, for the offence punishable under Sections 115 (2), 118 (2), 125, 189 (2), (4), 190, 191 (3), 351 (2) of BNS, 2023.
3] The learned APP submits that in the event this Court grants interim protection, the applicant be directed to attend the concerned police station and co-operate with the investigation.
4] This Court, by order dated 26.03.2025 in ABA No.2049/2024, has granted anticipatory bail in favour of co-accused for the reasons stated in para no.5, as noted below :
5] Considering the nature of injuries are simple and both the parties have suffered injuries and as it is difficult to ascertain who is the aggressor at this moment, considering this aspect, the interim protection granted earlier can be confirmed. 5] Considering the above observations and considering that the injuries are simple in nature, the applicant is granted anticipatory bail in the following terms :
i] In the event the applicant/s is/are arrested in connection with Crime No. 0425/2024, registered with Pundliknagar Police Station, Aurangabad, for the offence punishable under Sections 115 (2), 118 (2), 125, 189 (2), (4), 190, 191 (3), 351 (2) of BNS, 2023, he shall be released on bail on furnishing PR bond of Rs.20,000/- with one or two sureties in the like amount to the satisfaction of the trial Court. ii] The applicant shall attend the concerned police station on 02.05.2025 between 10.30 a.m. and 1.30 p.m. and thereafter as and when required by the investigating officer.
iii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case.
iv] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.
v] Failure to attend the concerned police station by the applicant, liberty is granted to the prosecution to recall the said order.
6] In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled.
7] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall proceed further in the matter without being influenced by the observations made hereinabove.
8] The application stands disposed of.
