Heard the learned Counsel for the applicant/wife. 2.

The respondent/husband who served twice but remained absent.

The applicant is seeking transfer of Petition No.A380/2021 pending in the Family Court, Nanded to the Family Court at Aurangabad. The petition is fled by the respondent/husband against the present applicant for taking divorce.

According to the applicant, she has fled proceeding

{2} under Section 125 of the Criminal Procedure Code in the Family Court at Aurangbad against the respondent and the respondent has also appeared therein.

It appears that, the applicant/wife is not having any independent source of income. Moreover, the one and half years old daughter of the rival parties is also residing with the applicant. Moreover the distance from Aurangabad to Nanded is more than 300 Km. The applicant has contended that, the respondent/husband is getting around Rs.30,000/- p.m. as a salary and since he is attending the dates of proceeding fled by the applicant at the Family Court, Aurangabad. The petition fled by the him at Nanded can be conveniently transferred. In view of the same, following order is passed.

ORDER

a.

The application is hereby allowed.

b.

The Petition No. A-380/2021 pending in the Family Court, Nanded is hereby transferred to the Family Court, Aurangabad for simultaneous disposal according to law alongwith Petition No.

{3} E-140/2022 pending therein.

c.

The respondent/husband is directed to appear before the Family Court, Aurangabad on or before 6th December, 2022.

d.

The application accordingly disposed of.
