ORDER:- 1.

The petitioner is praying for issuance of directions to grant him extension for a period of one year so as to facilitate him to complete B. Tech. (Agri. Engineering) Degree. 2.

It has been pointed out that the petitioner was admitted to B. Tech (Agriculture Engineering) degree course in the year 2007-08. The petitioner could not complete the course within period of eight years i.e. upto 2015-16. Under the relevant regulations, a student appearing for B.Tech degree course shall have to complete the course

2 WP5896.2017 within the extended period of eight years although the course is of four years' duration. The petitioner has already completed eight years duration and has also been erroneously granted benefit in respect of extension for the 9th year. The petitioner could not complete the degree course even within the period of nine years. Though it is informed by the counsel appearing for the university that the officials who are responsible for erroneously granting extension for the period of one year in favour of the petitioner are being prosecuted and a departmental inquiry has been proposed against such of those persons who are found irresponsible, it cannot be lost sight of the fact that the petitioner, who is beneficiary of illegality, must also be assumed to be party to such illegality. 3.

In exercise of extra-ordinary jurisdiction available under Art. 226 of the Constitution of India, no interference is called for. The petition being devoid of merits, stands dismissed. [ A. M. DHAVALE ] [ R. M. BORDE ] JUDGE JUDGE sgp
