Heard the learned Counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in connection with FIR No.142/2025 dated 17/03/2025, registered with Rahata Police Station, District Ahilyanagar, for the offences punishable under Sections 118(1), 118(2), 352, 351(2), 351(3) r/w 34 of the Bharatiya Nyaya Sanhita, 2023.

The case against the present applicant is that on 13/03/2025 at about 21:15 hours, while the informant was engaged in household work in front of her house, the applicant, along with other family members, allegedly came to her residence armed with an iron rod. They objected to the use of the road by the informant's tractor and claimed that it should not be used for such purpose. The informant responded that the road is a public road and could be used accordingly. It is then alleged that the applicant and his family members assaulted the informant, and the applicant, using an iron rod, struck the informant on the face, causing a cut on her lip and breaking one of her teeth. 1 of

The learned Counsel for the applicant submits that the applicant undertakes to stay away from the place of incident, namely Gorde Vasti, Astgaon, Taluka Rahata, District Ahilyanagar, and instead reside at Rahata. He also undertakes not to communicate with the informant or her family members in any manner. The statement is accepted and taken on record. 5.
Considering the aforesaid submissions, and the fact that the investigation is nearly complete and the trial is likely to take considerable time for conclusion, this Court is of the opinion that the applicant deserves to be released on regular bail.

In view of the above, the application is allowed on the following terms:- a] The applicant shall be released on bail in connection with FIR No.142/2025 dated 17/03/2025, registered with Rahata Police Station, District Ahilyanagar, for the offences punishable under Sections 118(1), 118(2), 352, 351(2), 351(3) r/w 34 of the Bharatiya Nyaya Sanhita, 2023, on executing a P.R. bond of Rs.25,000/- with one or two sureties in the like amount, to the satisfaction of the trial Court.
b] The applicant shall not, in any manner, contact or attempt to contact the informant or her family members during the pendency of the trial.
c] The applicant shall co-operate with the trial Court and shall 2 of
941 BA 713-2025 remain present on all scheduled dates of hearing, unless exempted by the Court.
d] The applicant shall not tamper with the prosecution evidence and shall not influence the informant, witnesses, or any other person concerned with the case.
e] Upon release, the applicant shall furnish his current residential address and contact number before the trial Court and shall inform the Court promptly in case of any change thereof.
f] The applicant shall not reside at Gorde Vasti, Astgaon, Taluka Rahata, District Ahilyanagar, and shall not visit the said locality.

Needless to state, in case of breach of any of the above conditions, the bail granted to the applicant shall be liable to be cancelled. It is further clarified that the observations made in this order are confined to the disposal of the present bail application and shall not influence the trial Court at any stage of the proceedings.
