IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD CONTEMPT PETITION NO.215 OF 2011 (Anil Madhavrao Solanke and others Vs.The State and others) IN WRIT PETITION NOS.5757 OF 2008, 5758 OF 2008, 2570 OF 2010 AND 2571 OF 2010 Mr.S.P.Katneshwarkar, Advocate for the petitioner. Mr.G.K.Kadam, Advocate for respondent Nos. 5 to 7. Mr.N.T.Bhagat, AGP for the respondent/State.

( CORAM : RAVINDRA V. GHUGE, J.) DATE : 13/12/2016 PER COURT :

1.

I have heard Mr.Katneshwarkar, learned Advocate for the petitioners for quite some time. This petition was filed in 2011 seeking an order of punishment as against the respondents for disobeying orders that were passed on 03/10/2008 and 23/03/2010. 2.

Considering the judgment dated 27.7.2016 delivered in WP Nos. 2570/2010 and 2571/2010, by which the concerned authorities have been directed to consider the cause of action and the grievance of the petitioners and decide the appeals on or before 27/10/2016, I am not inclined to entertain this petition and especially after a passage of about 8 years from the date of the first order at issue. khs/DEC.2016/-d

3.

This contempt petition is, therefore, disposed of. However, the respondent/authority, which is the Additional Tribal Commissioner in the two writ petitions, shall ensure that the pending appeals shall be decided within the time frame granted or extended time as the case may be.
