Mr. Shaikh, learned counsel for the petitioner states that the petitioner was declared surplus and absorbed in other institution. Subsequently there is vacancy in the parent institution. The petitioner has claimed repatriation. Even an application is given to the Deputy Director of Education, however, the same is not considered as yet. 2.

Considering the fact that the application is already filed, with respondent No.2, the respondent No.2, the Deputy Director of Education, shall take decision on the application of the petitioner (Exh D, page 22), on its own merits in accordance with law, expeditiously preferably within two moths.
