Heard learned counsel for applicants, learned AGP for respondent-State and learned counsel for respondent No.3. 2.

Learned counsel for applicants submits that, in connected group of matters, this Court has permitted the respondents to withdraw the 60 % amount i.e. Civil Application No. 4180/2021. Hence the same order be passed in this matter.

Learned counsel for respondent No. 3 has not disputed the fact that this Court has allowed the claimants in

connected matters to withdraw the amount. Hence, I pass the following order :

O R D E R

(i) The applicants - claimants are permitted to withdraw 40% of the deposited amount on submitting an undertaking to the satisfaction of the Registrar (Judicial) of this Court.

(ii) The applicants are permitted to withdraw further 20% of the deposited amount on submitting solvent surety in the like amount to the satisfaction of Registrar (Judicial) of this Court.

(iii) Balance 40% amount be invested in the Fixed Deposit Receipt in any Nationalised Bank for the period till disposal of the appeal.

(iv) The application for withdrawal of the amount stands disposed of.
