Impugned order dated 29th May, 2020 is during the period of lock down.

It was inappropriate on the part of the committee to expect the litigant to attend the office of the committee and file the documents in May 2020. The impugned order states that on 11th May, 2020, the petitioner was directed to file documents. Judicial note can be taken of the fact that there was lock down during the said period. Still the committee ventures to pass the impugned order. It is not only inappropriate but also highly irresponsible on the part of the committee to expect the litigant to attend the office of the committee when the persons were precluded from traveling from one place to another.

It is submitted that subsequently the petitioner has filed the proceeding online. Same has been accepted. It is submitted that now the committee is functioning. The petitioner shall also file the papers in physical form within seven days from today if the committee commences physical work.

In light of above, the impugned order is quashed and set aside. Writ petition is disposed of. No costs.
