IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 918 WRIT PETITION NO. 4183 OF 2018 ANANT RAMESH PATIL

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioner : Mr. Ajay G. Talhar AGP for Respondents: Mr. S.S. Dande CORAM : R.M. BORDE & K.K. SONAWANE, JJ.

DATE : 26th April, 2018.

PER COURT:- 1] This writ petition deserves to be rejected only on the ground that the petitioner has uploaded manipulated documents i.e. Form No.6 affidavit, while submitting the on-line application. The document i.e. Form No.6 has been uploaded twice by the petitioner. While uploading the document on the first occasion, the following line was not recorded :- "Recharge Trench and Reacharge shaft at Kamarawad and shahana taluka Shahada, dist Nandurbar."

2] While uploading the Form No.6 affidavit on the second occasion, the above referred sentence appears in the affidavit. The sentence seems to have been included lateron. It does not have any link with the previous or subsequent sentence recorded in the affidavit. Apart from the manipulation as referred to above, the tender document of the petitioner has been turned down on account of other two reasons, i.e. Turn Over Certificate by the Chartered Accountant has not been presented by the petitioner and the petitioner does not fulfill the requirement as regards financial capacity.

{2} 918 sr.no..odt 3] It is informed that the successful bidders have already been issued the work orders. The tender work is of the duration of three months and work is to be completed before the onset of monsoon. Considering the nature of work allotted to successful bidder and the deficiencies as recorded above, the petition presented by the petitioner does not deserve favorable consideration. Writ petition stands rejected. [K.K.SONAWANE, J] [R.M. BORDE, J] grt/-
