Mr Garud, learned Counsel appearing on behalf of the appellant makes a motion for disposal of the appeal, as according to him, the matter is already settled before the executing court. The appeal, as such, stands disposed of.

Learned Counsel makes a statement that as the Darkhast is disposed of, the statutory amount of Rs.25,000/- along with interest be refunded to him. The prayer stands granted.
