1] Having heard learned counsel for the appellant for some time, the first appeal wherein interim award of payment of "No Fault Liability" ordered by the Motor Accident Claims Tribunal, Aurangabad, on January 19, 2015, is questioned on the ground of liability to pay, the same can be conveniently disposed of by remitting the amount deposited in this Court to the Motor Accident

FA 1683/15 with CA 7739/15 - 2 - Claims Tribunal, Aurangabad, in Motor Accident Claim Petition No.489/2015.

2] Before permitting withdrawal of the amount, the Motor Accident Claims Tribunal may take into account the objection as may be raised.

3] First Appeal is disposed of accordingly. No order as to costs. It is made clear that this court has not examined the merits of the matter. In view of this, Civil Application No.7739/2015 for stay does not survive and disposed of as such.
