1] Both these applications arise out of judgment and order, dated 28.3.2016 passed by the learned Additional Sessions Judge, Jalgaon in Special (ACB) Case No. 6 of 2015 convicting applicants of the offences punishable under the Prevention of Corruption Act, 1988.
crap2241.16 2] Heard Shri Joydeep Chatterjee, learned counsel for applicants and Smt. R.K.Ladda, learned A.P.P. for respondent/State. Perused the impugned judgment and order.
3] Learned counsel for applicants submits that applicants were on bail during trial.
4] Considering the short term sentence awarded by Trial Court and since applicants are on bail pending trial, this Court is inclined to allow the applications. Hence the following order. O R D E R (i) Criminal Application Nos. 2241 and 2242 of 2016 are allowed.
(ii) Substantive sentence of imprisonment is suspended till the decision of Criminal Appeal Nos. 266 and 267 of 2016.
(iii) Applicants are released on bail on P.B. and S.B of Rs.15,000/- each.
(iv) Bail before the Trial Court.
