1] In the affidavit in reply presented on behalf of respondent nos.3 & 4, it is recorded in paragraph no.15 that the petitioner nos.1 to 5, 7, 8, 10 and 11 have obtained requisite score thereby rendering them eligible for inclusion in the BPL list of village Virgaon Tq.Vaijapur Dist.Aurangabad. It is further recorded that since there is a limit of 84 families prescribed for inclusion in the BPL list and since the list has already been exhausted, the petitioners' names are required to be

WP 6288/14 - 2 - placed in the waiting list. It is further recorded that as and when any of the 84 families included in the BPL list gets deleted for any reason mentioned in the Government resolution dated 27.8.2010, the claim of the petitioners for inclusion in the BPL list would be considered.

2] In view of the statement made in paragraph no.15 of the affidavit in reply, the grievance raised by the petitioners in the instant petition substantially stands redressed. The petitioners also claim that there are many ineligible families included in the BPL list. It would be open for the petitioners to tender appropriate complaint / representation to the Collector setting out particulars therein and it would be open for the Collector to consider such complaint / representation by himself or by his subordinate officer including the Project Director, District Rural Development Authority, expeditiously.
