This is an application for suspension of substantive sentence awarded by learned Additional Sessions Judge, Aurangabad in Sessions Case No.321/2017.

Heard the learned Advocate for the applicant/ appellant, learned Addl. P.P. for the respondent and learned Advocate appointed for respondent No.2 (P.W.1). 3.

We have perused the papers on record. The case is based on the account of the eye witnesses. The eye witnesses

were injured in the incident. The deceased was the brother-in-law of the applicant. The weapon used in the crime is knife, which caused 8 stab injuries on the deceased. No case is made out for suspension of sentence and hence, the Criminal Application is dismissed.

Fees of Ms Ashwini Lomte, learned appointed Advocate for respondent No.2 is quantified at Rs.5000/- (Rupees five thousand).
