The petitioners have challenged the order passed by the University and College Tribunal, Aurangabad dated 12th January, 2018, whereby the appeal filed by present respondent No. 2 is allowed and the termination order dated 22/25 May, 2015 issued by the petitioners is quashed and set aside.

Respondents No. 2 and 3 in the appeal, i.e. present petitioners were directed to give service benefits from the date of suspension till the date of reinstatement, along with arrears of back wages, treating respondent No. 2 in service, on notional basis. Since respondent No. 2 is retired from service, he was

{2} wp593-19 also held entitled for post retirement benefits of the post held by him with the petitioners college.

The petitioners were also directed to submit pension papers of respondent No. 2 for sanction of pension and the benefits arising thereof, if his service conditions are subject to eligibility of the pension benefits after retirement. 4.

During pendency of this petition, the parties opted for mediation and the parties were referred to mediation by appointing Principal District and Sessions Judge, Dhule as Mediator. The Mediator has submitted a report on 28th June, 2022 informing that mediation is successful and has forwarded original terms of compromise arrived at between the petitioners and respondent No.2. The terms of compromise are taken on record and marked "X" for identification. The writ petition is, therefore, disposed of in terms of compromise, Exhibit-X. [NITIN B. SURYAWANSHI] JUDGE drp/wp593-19
