By this petition filed under Article 226 of the Constitution of India, the petitioner has impugned the order passed by the Election Authority accepting the form of respondent no.5 and rejecting the objection raised by the petitioner not to accept such form on the ground that respondent no.5 had three children and was not eligible to contest the election in view of Government Resolution dated 12.09.2001.

Perusal of page no.14 of the petition clearly indicates that the election program is already declared and various steps are already taken pursuant to the said election program. This Court thus cannot 1/2

957-wp-4679 OF 2022.odt interfere with the election program at this stage. Writ petition is accordingly dismissed. No order as to costs. 4.

It is made clear that the petitioner would be at liberty to file appropriate proceedings at the outcome of the election under the appropriate Act.
