Present application has been filed for withdrawal of the amount deposited by the present respondent No.1 - appellant as per the orders of this Court.

Taking into consideration the fact that the present applicant was the original claimant who had received the injuries and that his claim petition was partly allowed on the ground that he has sustained 85 % of permanent disability, certain amount deserves to be allowed to be withdrawn to him. Amount of Rs.10,93,847/- is deposited in this Court.

Under the said circumstance applicant is allowed to withdraw

CA 6194-2018 amount of Rs.5,00,000/- out deposited amount. He shall submit the undertaking that, he would make the good for said amount, in case he is directed at the time of final disposal of the first appeal in that behalf.
