On being confronted with a remedy of revision being available with the State Government against the order passed by the Commissioner of State Excise, Maharashtra State, Mumbai, the Counsel for the petitioner seeks leave to withdraw the writ petition with liberty to approach the Commissioner before the State Government. Upon the revision being filed before the State Government, the time spent in writ petition, despite availability of alternative and efficacious remedy would be given due weightage to, if at all the issue is raised that the revision is not within limitation. With the aforesaid observation, the writ petition is disposed of as withdrawn with liberty as prayed for.
