Heard learned Counsel for the applicant.

The record shows that Respondent-husband, though served twice, but remained absent.

The applicant is seeking transfer of HMP No.77 of 2020, pending with the learned Civil Judge, Senior Division, Panvel, District Raigad, to the Family Court, Aurangabad. It is pointed out that distance between Panvel and Aurangabad is approximately 340 Kms.

It is to be noted here that the applicant-wife has also filed two proceedings against the Respondent-husband, one is under the provisions of Protection of Women from Domestic Violence Act, 2005, pending in the Court of JMFC at Aurangabad

{2} mca120.22.odt and the other under Section 125 of Code of Criminal Procedure, pending in Family Court at Aurangabad. It is pointed out that the Respondent-husband is attending the dates in these two proceedings.

Under the circumstances and considering the convenience of the applicant-wife, following order is passed: (i) Misc. Civil Application is hereby allowed and HMP No. 77 of 2020, pending in the Court of Civil Judge, Senior Division, Panvel, District Raigad, is hereby transferred to the Family Court, Aurangabad, for its simultaneous disposal along with E-Petition No. 08 of 2020, pending there, as expeditiously as possible.
