Heard the learned senior counsel for the applicant and the learned APP for the respondent-State.

The applicant is seeking bail in Crime No.398 of 2022, registered with Police Station Vimantal, District Nanded, for the offences punishable under Sections 302, 364, 341, 120-B, 143, 147, 148, 149 of the IPC and Section 135 of the Maharashtra Police Act.

3. The applicant has submitted C.C.T.V. footage to the Investigating Officer for verification that at the time of the alleged incident, he was sitting in his home. The Investigating Officer has verified the C.C.T.V. footage and satisfied that at the relevant time, the present applicant was in his home.

The similarly situated co-accused has been released on bail by this Court. In the set of facts, the applicant deserves bail. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant MUHAMMAD SADDAM SAJEED QURESHI be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.398 of 2022, registered with Police Station Vimantal, District Nanded, for the offences punishable under Sections 302, 364, 341, 120-B, 143, 147, 148, 149 of the IPC and Section 135 of the Maharashtra Police Act, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the trial on each and every effective date.
