The petitioner is praying for refund of the earnest amount deposited in accordance with clause 1.1(17) of the tender conditions. It cannot be disputed that the petitioner, who is an unsuccessful bidder, is entitled to claim refund of earnest money deposited. Counsel appearing for the respondent Municipal Corporation states that the earnest amount would be refunded to the petitioner as expeditiously as possible, preferably within a period of two months from today. The statement made is accepted. Writ Petition is accordingly disposed of.
