Learned counsel for the applicant-original claimant submits that the first appeal came to be disposed of in terms of the compromise arrived at between the parties in Lok Adalat held on 23.1.2016 and as per the terms of the compromise, the applicants herein are permitted to withdraw 75% of the amount deposited before this Court and remaining amount is waived by the applicants-claimants. Learned counsel for respondents acquiring body has not disputed this position and submits that, the acquiring body has no objection if the amount is paid as per the prayer clause 'B' of the civil application.

In view of the above submissions and for the reasons stated in the application, civil application is allowed in terms of prayer clause B and disposed of. ( V.K. JADHAV, J. ) ...
