VERSUS

GRAM PANCHAYAT THROUGH ITS GRAM SEVAK AND ANOTHER Advocate for Petitioner : Mr. A.R. Vaidya.

Advocate for Respondent Nos. 1 & 2 : Mr. Sharad S. Shinde h/f. Mr. V.V. Bhavthankar.

CORAM : RAVINDRA V. GHUGE, J.

Dated : 18th June, 2018 Per Court :

1.

I have heard the learned advocates for the respective sides.

2.

The petitioner/original plaintiff is before this Court being aggrieved by the order of the Appellate Court setting aside the order of the Trial Court by which the plaintiff was granted injunction.

3.

It is informed that R.C.S. No. 270/2013 (Old No. 317/2012), is now awaiting final arguments. Recording of oral evidence has been concluded and the parties closed their evidence.

4.

Considering the above, I deem it proper to observe that the Trial court would proceed with the pending suit and decide the same as expeditiously as possible and preferably on/or before the 31st day of August, 2018. Learned advocates for the respective sides assure that they would conclude their oral submissions on/or before the 21st day of July, 2018. 5.

This Writ Petition, is therefore, disposed of with the above directions.
