The petitioner is aggrieved by the fact that in spite of he having attempted to file a complaint in writing on 25 March 2023 disclosing commission of a cognizable offence, offence has not been registered as is expected by Lalita Kumari Versus State of Uttar Pradesh, (2023) 9 SCC 695.

However apparently, the initial complaint filed by the petitioner exhibit 'C' is addressed conjointly to the concerned PI and the Superintendent of Police. There is no material to demonstrate that the petitioner has complied with Section 154 (3)

of Cr.P.C. which is a precursor to cast an obligation on the Superintendent of Police.

We dispose of the Writ Petition by permitting the petitioner to undertake the exercise and comply with the provision of Section 154 (3) of the Cr.P.C. and granting him liberty to resort to any other appropriate remedy under Section 200, 156 (3) of the Cr.P.C.
