This petition is moved for withdrawal on instructions of the petitioner who is present in the Court. Learned Advocate for the petitioner Mr. Garud placed on record a communication received by him from the Chairman and Secretary of the petitioner society requesting him to withdraw the petition. Along with the letter he has annexed resolution passed by the members of the society.

Learned Advocate Mr.Golewar, who has filed intervention application, opposes withdrawal of the petition. He submits that the applicants in Civil Application No. 4928 of 2024 are also members of the society. His apprehension is that if the petition is withdrawn, the

( 2 ) wp8980.21 Authorities will not proceed with re-audit or test-audit, which was directed on the complaint of the petitioner.

This Court finds that the apprehension of the intervention applicants is misplaced. It is always open for the parties to agitate their grievance as provided under law before appropriate Authority. Reserving the right of the applicants to agitate their grievance as provided under law, the petition stands disposed off as withdrawn. Needless to say that the interim relief shall stand vacated. Pending civil application also stands disposed off.
