Heard the learned Advocates for the parties.

The attention of the Court is invited to the order dated 2 May 2025. By such order, the Applicant has been protected in terms of certain terms and conditions which have been specifically recorded in Paragraph No. 6 of the order. Prima facie, findings/observations are recorded in the Court in the order, to which there is no further submission by the prosecution.

Today, when the Application is listed, the learned APP, on written instructions, would point out that the Applicant has

- 2 - appeared before the Investigating Officer on 8 May 2025 and 9 May 2025 respectively. He has co-operated with the investigation. It is thus clear that the Applicant has joined the investigation. 4.

At this stage, the learned Advocate for the Applicant would submit that the Applicant is presently employed with the Maharashtra State Security Board, Thane. He has annexed letter of the said Board dated 30 August 2024 to substantiate such appointment. The same has been perused. The learned APP would not have any objection to this. Considering such facts and circumstances, the interim order dated 2 May 2025 needs to be confirmed and the ABA deserves to be allowed by passing the following order, in the interest of justice.

ORDER

(i) In the event of arrest of the applicant Akshay s/o Nandu Ugale, in connection with C.R. No. 0013/2025, registered with Akole Police Station, Dist. Ahilyanagar, for the offences punishable under Sections 309(2) of the BNS, the applicant is directed to be released on bail on furnishing PR bond in the sum of Rs. 20,000/- (Rupees Twenty Thousand Only) with one solvent surety in the like amount.

(ii) The applicant shall attend the concerned Police

- 3 - Station as and when called and co-operate the investigation, until filing of the charge-sheet. (iii) The applicant shall furnish details of residential address and other contact details such as the mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately informed to the concerned police station. (iv) The applicant shall surrender his passport, to the concerned Police Station. The Application is permitted to visit Mumbai for the purpose of his employment. He shall furnish all his contact details, mobile numbers, complete residential address in Mumbai, including address of his work place in Mumbai with the Investigating Officer of the concerned Police Station and not leave India without prior permission/orders of the competent Court.

(v) He shall not contact and/or influence the witness/es and/or tamper with the evidence in any manner whatsoever.

ABA is allowed in above terms.
