Heard both the sides.

Mr. Gunale, learned counsel appearing for the respondent strongly opposes the application and the respondent filed affidavit-in-reply.

I have perused the contents of the application. The learned counsel appearing for the applicant submits that, at the relevant time the applicant went to Saudi Arabia for the purpose of Haj-Yatra and there is endorsement in his pass-port to that effect. As against this, Mr. Gunale, learned counsel submits that, at the relevant time of the alleged visit of the present applicant to the Saudi Arabia there was no HajYatra, therefore, contention raised in the application are false.

Learned counsel for the applicant further submits that, the second appeal presented by the present appellant was not accepted by the office since no second appeal lies against the impugned order. Therefore, the present applicant filed civil revision application against the impugned order.

For the reasons stated in the application, I am satisfied that the delay caused for filing the appeal has been properly explained and it is not intentional. In view of the above, delay caused for filing civil revision application is condoned.

Civil application is disposed of.
