The salary of the petitioner is stopped by virtue of communication dated 29.1.2011 on the ground that the strength of the students has reduced.

Mr.Deshpande, learned counsel submits that for the next academic year 2011-12, the strength of the students has increased and the same has consistently increased every year, as such the petitioner would be entitled for the salary. The petitioner would forego the salary for one year i.e. the period for which the strength is reduced.

Learned A.G.P. states that review of admissible and vacant post for aided colleges is taken every year and in case of petitioner, review has been undertaken and the Joint Director of Higher Education has sent its report to the Government for its consideration and approval. 5.

The Government shall take decision on the said report submitted by the Joint Director of Higher Education, with regard to the admissibility of the post with the Respondentinstitution expeditiously, preferably within four

(4) months and depending upon the decision taken by the Government further process be undertaken with regard to payment of salary to the

The Writ Petition is accordingly disposed of. No costs.
