The learned AGP has placed on record the communication transmitted by the Director of Medical Education and Research, Mumbai dated 25.4.2018, disclosing the following facts:- (i) During the first round, the petitioner was considered eligible for PWD quota and was allotted M.D.(Paediatrics) speciality at TNMC, Mumbai.

(ii) In the next round, he was considered for betterment and was allotted a seat at BSMT, Mumbai in M.D.(Paediatrics) speciality.

(iii) The petitioner has joined the course.

BENCH AT AURANGABAD 2 - WRIT PETITION NO. 4189 OF 2018 (iv) It is reported that as on 23.4.2018, there are 41 vacancies in PWD category and the Director, Medical Education and Research will conduct one more betterment round for alloting the remaining vacancies to the eligible PWD candidates and during that round, the claim of candidates for betterment, including the petitioner, would be considered, according to their preferences recorded in the application.

(v) It is further reported that after last round the remaining vacancies would be surrendered to the State, in view of the communication as specified above.

In this view of the matter, the grievance of the petitioner in the instant petition stands redressed. Writ Petition is accordingly disposed off.
