Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant is apprehending arrest in connection with Crime No. 157/2024 dated 8.3.2024 registered with Karjat Police Station, District Ahmednagar for the offences punishable under sections 419, 420, 468, 471, 507 of I.P.C.

This Court by order dated 29.4.2024 has granted interim protection to the applicant. The learned counsel for the applicant submits that thereafter the applicant has cooperated with the investigation. 4.
Prima facie, the allegation against the applicant is that the applicant sought money from the informant and others under the pretext that he has capacity and power to have confidential information regarding the proposed national high way road so that appropriate investment can be made by the informant and others and can get benefit out of the said information. There are also civil disputes pending between the parties. Prima facie the money paid to the applicant is for illegal purpose. This Court has granted interim
ABA 653/24 protection to the applicant on 29.4.2024 and that the investigation in the matter is almost completed. Considering the maximum punishment provided for offence under section 420 of I.P.C. is seven years and considering the purpose for which the information was sought being illegal and the investigation in the matter has also been proceeded, I hold that interim protection granted earlier can be confirmed. 5.
In view of the above, the application is allowed and the interim protection granted on 29.4.2024 is confirmed on the following terms : i] The applicant shall attend the police station as and when required.
ii] The applicant shall not tamper with the evidence of the prosecution in any manner. He shall not influence the informant, witnesses and other persons concerned with the case. iii] The applicant shall co-operate with the investigation and also in the proceedings before the trial Court.

In the event, the applicant violates any of the conditions specified in this order, it shall be liable to be cancelled. 7.
It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall not be influenced by the observations made hereinabove. 8.
The application stands disposed of.
