The learned prosecutor submits that the prosecution has examined four witnesses in Sessions Case No.36 of 2015. 3.

Considering that the sessions case is pending for more than five years, we expressed a view that trial in the sessions case could be made time bound.

The learned advocate for the appellant, therefore, submits that the appellant would not press this appeal. 5.

In view of the above, this appeal is disposed off. 6.

The learned Additional Sessions Judge, Kandhar, Dist. Nanded, is called upon to decide Sessions Case No.36 of 2015 as

In the event, the time frame granted is not respected on account of the delaying tactics or for any reason, not attributable to the conduct of the accused, the accused would be at liberty to pray for regular bail and in the event such an application is filed, the trial Court would decide the same or its own merits.
