The applicants are seeking permission to condone the delay of 1139 days in filing second appeal. The learned counsel for respondent No.1 by filing affidavit in reply, strongly opposed the application on the ground that there are concurrent findings of both learned courts below. However, at this juncture the application stands allowed in terms of prayer clause-B subject to cost of Rs.2000/- to be paid to the Registry of this court for

2 933 ca 6919-23 utilization of Dispensary, High Court, Aurangabad within two weeks.
