Heard learned advocate for applicant. It is the contention of the applicant that the appellant No. 3 Chandrakant s/o Nagorao Dabir, died on 13th March, 2015. It is alleged that the appellant No. 3 died leaving behind his 3 legal heirs as stated in para 2 of this application.

This application is supported by affidavit. The copy of Death Certificate Exh. A indicates that Chandrakant s/o Nagorao Dabir, died on 13th March, 2015. The present application is filed by the applicant on 27th April, 2015. There is no contest. cast.6529.15

Thus, It is abundantly clear that the application filed by the applicant is within limitation, and liable to be allowed. In the result, I proceed to pass following order.

The Civil Application No. 6529/2015, is hereby allowed. The applicants are permitted to bring on record the legal heirs of deceased appellant No. 3 Chandrakant s/o Nagorao Dabir, within the period of 14 days from the date of this order. The necessary amendment be carried out in cause title of the memo of appeal.

The Civil Application is stand disposed of.
