1] Liberty is granted to amend the prayer clause-C forthwith.

2] The present Civil Application is filed to bring on record the legal heir of deceased applicant, namely, Prayagbai Prabhu Shirmale by condoning delay of 173 days in filing the present Civil Application.

3] The learned counsel for the applicants submits that one of the legal heirs of the deceased Prayagbai is already on record, as such, only applicant no.1-A be added as legal heirs of the deceased Prayagbai in the matter.

4] For the reasons stated in the Civil Application, the same is allowed. Delay is condoned. Abatement, if any, is set aside. Civil Application is disposed of accordingly. Necessary amendment to be carried within three weeks. [ARUN R. PEDNEKER] JUDGE DDC
