The Petitioner prays that the proposal dated 30.07.2020 seeking approval to the transfer of the Petitioner from the unaided establishment to the 100% aided establishment, is pending with Respondent No.2. He places reliance upon the judgment delivered by this Court in Ajay Vishwanath Kharde Vs. State of Maharashtra and others, 2002(2) Mh.L.J. 649.

It is obvious from this matter that Respondent No.2 has merely been sitting upon the proposal dated 30.07.2022. This has constrained the Petitioner to file this Petition. We could have initiated action against Respondent No.2 Shri Audumbar Ukirde, Deputy Director of Education, Pune Division, u/s 10 of the Maharashtra Government Servants Regulation of Transfers and Prevention of

4755.2023WP -2Delay in Discharge of Official Duties Act, 2005. However, this time we are pardoning the said authority.

As such, this petition is disposed off with the direction to Respondent No.2 to decide the proposal dated 30.07.2022 in the light of the judgment delivered by this Court in Ajay Vishwanath Kharde (supra), within 30 days from today.
