This Petition is filed taking exception to the order dated 25th January, 2024, whereby the First Appellate Court in R.C.A. No. 22 of 2024 refused to grant status quo.

Learned Counsel for the Petitioners/original Appellants submits that the Application (Exhibit 5) is not being heard by the Appellate Court. It is his submission that during the pendency of the suit, order of status quo was granted and the same continued till disposal of the suit. It is his further submission that the order of status quo be extended further.

Admittedly, the order impugned is passed on 25th January, 2024. Since then there is no order of status quo or any order in respect of the subject property. The Application (Exhibit 5) is yet to be decided by the Appellate Court in R.C.A. No. 22 of 2024. It would be appropriate 913 WP 5618.2024.odt

to direct the Appellate Court to decide the Application (Exhibit 5) expeditiously.

In case the service of the Respondent in R.C.A. No. 22 of 2024 is complete, Application (Exhibit 5) be decided within a period of one month from today.
