We considered the strenuous submissions of the learned Advocate for the Petitioner, learned AGP and Shri. Dande, the learned Advocate for the MIDC. 2.

Considering the issue raised before us, we do not intend to exercise our Writ jurisdiction. Suffice it to say that the Petitioner can approach the MIDC with a representation, if not already filed and MIDC will consider the representation, or he may prefer a proceedings before the Civil Court for the redressal of his grievance. All contentions are kept open.
