By the present Criminal Application, applicants are seeking their release on anticipatory bail since they are under apprehension that they will be arrested in connection with Crime No. 6/2015 registered with police station Ambi, Dist. Osmanabad for the offences punishable u/s 395,363 of the Indian Penal Code and u/s 3 read with 25 of the Indian Arms Act.

Heard Mrs. S.K.Doke (Renge), learned counsel for the applicants and Mrs. S.G.Chincholkar, learned A.P.P. for Resp. - State.

F.I.R. is lodged by Waman s/o Namdeo Shinde.
2 Cr.Apln. 2310.2015 In so far as present applicants are concerned, according to the learned A.P.P., during the course of investigation and from the F.I.R., it is clear that no specific role of snatching of any valuable property is ascribed to the applicants. From the F.I.R., it is clear that the applicants were standing out side the house of the first informant when the incident had taken place inside the house, in which other accused persons had participated. According to learned A.P.P., other accused persons are already arrested and they are released on bail. 4.
Looking to such nature of the accusations made in the F.I.R. and the investigation, present applicants who are ladies, can be protected by exercising discretion in their favour.

Hence, I pass the following order :
(i) Present Criminal Application is allowed.
(ii) Interim order passed by this Court on 29/04/2015 stands confirmed.
(iii) Present Criminal Application is disposed of.
