By this Application, the Applicants (Original Petitioners) are seeking a direction against the Respondents for grant of status of permanent employees and for the other benefits connected therewith, including pensionary benefits in terms of new pension scheme.

It is noted that the Applicants have continued in service and some of them superannuated on the basis of interim

(( 2 )) 918-CA-4701-2025 order passed by this Court, which was confirmed when 'Rule' was issued on 23.07.2009.

We are of the opinion that Writ Petition itself ought to be finally heard, for the reason that granting any indulgence in the present Application, would virtually mean granting final relief at interim stage.

In view of the above, the Civil Application is disposed of by directing that Writ Petition No.3377 of 2007, shall be listed for final hearing on 12.09.2025 at 3.30 p.m.

At this stage, it is brought to our notice that a no instructions pursis has been filed as per inward No.2791 of 2025 dated 19.07.2025, by the Advocate appearing on behalf of Respondent No.3, along with copy of intimation sent to Respondent No.3 about inability of the Advocate to appear for the said Respondent as he no longer continues in the panel. The notice was served upon Respondent No.3 on 17.07.2025.

In this backdrop, the Advocate appearing for Respondent No.3 Mr. Shivaji T. Shelke, is discharged from further appearance on behalf of the said Respondent in the Petition.
