PER COURT :- 1.
Petition seeks direction to pay unpaid salary of six months to the petitioner. The respondents did not deny their liability to pay salary to the petitioner for the period in question. In fact, part of the salary was already paid prior to filing of the petition. Facts revealed in the affidavit-in-reply discloses that, one bill of Rs.25,000/- and odd amount was pending with the Education Officer. In 2003 the Education Officer admitted that, such bill is received and amount would be released as soon as budget would be available. If this amount is paid to the petitioner in due course, the petitioner would have no grievance, but it seems that after 2003 the petitioner has not come to the Court neither he met his Advocate to inform as to whether he received the amount. 2.
In view of the facts of the case, we are of the view that, amount of the bill must have been paid to the petitioner and that is why he is ignoring the petition.
