After the hearing in this matter progressed to some length, the learned advocate for the petitioners confessed that execution proceedings have already been initiated against the husband of petitioner No.1, who is the father of petitioner Nos.2 and 3, before the concerned Family Court which had granted maintenance amount to the petitioners. 2.

We could have dismissed this petition by imposing costs as this petition was a chance petition filed by the petitioners. However, since petitioner No.1 is the estranged wife and is shouldering responsibility of two minor children, we are not imposing costs.

In view of the above and since the execution proceedings are already filed and are pending, this Writ Petition is disposed off without costs.
