PER COURT :- Shri Bachate, learned Advocate for the respondent / management and School, has submitted that a corrected pay bill has been tendered to the Education Department and very soon the applicant would be paid his entire unpaid salary. Learned Advocate for the applicant submits that the applicant is starving only on account of the apathy shown by the management towards him. Despite the orders of this Court dated 20.4.2009, delivered in Writ Petition No.996 of 2009, the applicant is made to run from pillar to post. There is also an order of conviction by judgment dated 27.2.2019 in Summary Criminal Case No.242 of 2012, by which, the President and Secretary namely, Rajkumar Trimbakrao Sawant and Rahul Pradhan were convicted.

BENCH AT AURANGABAD 2- CIVIL APPLICATION NO.10170 OF 2019 In view of the above, as Shri Bachate prays for a time of two weeks, S.O. to 6.9.2019 in the Urgent Orders Category. Until then, the management shall ensure that the salary bills for making the payment to the applicant are cleared, failing which the management shall deposit the entire amount in this Court through its coffers or the pockets of the President and the Secretary.

Civil Application No. 5276 of 2019 praying for listing the Writ Petition for an early hearing is allowed, subject to the compliance of the order on Civil Application No.10170 of 2019, list Writ Petition No.996 of 2009 for final hearing on 10.10.2019.
